Terms of Service
These terms govern a clinic’s use of Kinea. By creating an account or using the service, the clinic accepts them.
Kinea is a product of Khoury Digital LLC, a limited liability company registered in Wyoming, United States.
The service
Kinea is clinic management software: appointment scheduling, patient records, clinical notes, payments and reminders. It is a tool for running a practice. It does not provide medical advice, and nothing in it replaces the clinical judgement of a qualified practitioner.
Accounts and responsibility
The clinic is responsible for its account, for the staff it grants access to, and for keeping credentials secure. The clinic is responsible for the accuracy of what it records and for having the lawful basis to record patient information. Tell us promptly if an account is compromised.
Patient data
Patient records entered into Kinea belong to the clinic. The clinic decides what is collected and why; we process it on the clinic’s instructions in order to provide the service. We do not sell patient data, and we do not use it to train models. See the privacy policy for detail.
Fees and billing
Kinea is sold as a monthly subscription, billed in advance, at the prices shown on our website for each plan. Card payments are made through our online reseller Paddle.com, which is the merchant of record for those orders: Paddle charges the card, issues the invoice and handles payment-related questions and refunds. Fees are exclusive of any taxes or bank charges that apply where the clinic is established; Paddle adds VAT or sales tax where the law requires it. If a payment fails we will tell you and may suspend access until it is resolved.
Cancellation
Either side may end the subscription at any time. Cancellation takes effect at the end of the paid month; access continues until then. On request within 30 days of cancellation we will provide an export of the clinic’s data. See the refund policy for what is and is not refundable.
Availability
We work to keep Kinea available and we take backups, but we do not currently offer a contractual uptime guarantee. Planned maintenance is announced in advance where we can. Keep your own records of anything you cannot afford to lose.
Liability
To the extent the law allows, our total liability in connection with the service is limited to the fees paid in the twelve months before the claim. We are not liable for lost profits or for clinical decisions taken using the software. Nothing here limits liability that cannot lawfully be limited.
Governing law
These terms are governed by the law of the State of Wyoming, United States. Nothing in them removes a protection a clinic has under the mandatory law of the country where it is established.
Changes
We may update these terms. If a change materially affects a clinic, we will give notice before it takes effect, and continuing to use the service after that date means the clinic accepts the new terms.
